Fasken represented the interests of Industrial Alliance in a class action brought against several of the province's automobile insurers.

The application for authorization of the class action sought damages related to allegations that insurers would use a scheme in which they provided to their policyholders who had suffered damages covered by their automobile insurance policies a pre-established list of bodyshop and garage owners to carry out disaster recovery repairs, while not disclosing to policyholders that, in exchange for the listing, the contractors in question had to pay the insurers a cash rebate.

This litigation affects the entire industry and is a major class action in Québec.
