Overview

Pavel Sergeyev is a partner in the firm’s litigation and dispute resolution group. His practice focuses primarily on the defence of complex, multijurisdictional class action proceedings.

Pavel routinely represents clients in significant and precedent-setting litigation matters. Notable examples include:

  • Successfully represented a defendant credit bureau in connection with a precedent-setting appeal before the Ontario Court of Appeal that settled that the tort of intrusion upon seclusion is not actionable against custodians of personal information based on an alleged failure to prevent a third party from gaining unauthorized access to information collected and held by the custodian.
  • Representing a pharmaceutical company in the most high-profile pharmaceutical legal proceeding in Canadian history—the opioid class action litigation.
  • Successfully defended the certification of a proposed class action against the defendant bank relating to a cybersecurity incident that allegedly impacted the personal information of approximately 6 million Canadian consumers (both at first instance and on appeal).
  • Successfully represented a defendant television production company in connection with a precedent-setting motion to dismiss a proposed class action for delay under the recently enacted section 29.1 of the Ontario Class Proceedings Act, 1992.
  • Defending a multinational precious metals production and exploration company in a securities class action.
  • Successfully represented a defendant credit bureau in connection with a novel motion to stay a parallel action in a multi-jurisdictional class proceeding as an abuse of process.
  • Successfully represented a veterinary pharmaceutical company in connection with a significant access to information case before the Federal Court of Canada and the Federal Court of Appeal. This case resolved a longstanding dispute concerning the standard of review to be applied in respect of appeals under the Access to Information Act and created new law by clarifying the evidentiary requirements for establishing whether a document or information is in the public domain.

As part of his practice, Pavel frequently works with expert witnesses and is well-versed in managing large and complex documentary productions.

Pavel has been recognized as a “Rising Star” (2023, 2024) and as a “Next Generation Partner” (2025) in Dispute Resolution in The Legal 500’s Canadian rankings, and as “One to Watch” in Corporate and Commercial Litigation in Best Lawyers' 2025 Canadian rankings.
