Overview

Luc Béliveau practises in the areas of restructuring and banking law. Luc was a member of the firm's Partnership Board from 2013 to 2020 and Chairman of the Board from 2015 to 2020.

Luc regularly represents debtors, borrowers, lenders, investors, creditors, receivers, monitors and trustees. He defends the interests of clients in restructurings, liquidations, recapitalizations, realizations of security interests, and asset recoveries.

Luc sits on the boards of several private corporations and also served on the Superior Court Liaison Committee, for both the Civil and Commercial Divisions. Bulletin January 31, 2024 Fasken 2023 Insolvency Insights 2023 saw an uptick in corporate insolvency filings and creditor-driven CCAAs, followed by a corresponding increase in interesting developments in insolvency law. There has been an overall trend towards prioritizing environmental obligations. Reverse Vesting Orders continue to be sought, with Canadian courts cautioning that they remain extraordinary relief. In the fall, the Quebec Court of Appeal issued its ruling in the Chronometriq matter, recognizing a court’s power to grant interim financing charges priority over CRA’s deemed trust claim in proposal proceedings under the Bankruptcy and Insolvency Act. We have prepared a summary of these cases and other notable developments in insolvency law that occurred throughout 2023. Read more
